In addition, in some exceptional cases, the courts have held that the entire contractual clause may exclude terms that are implicit in the uses or uses.12 However, it is important to carefully read the wording of the entire contractual clause to ensure that the parties were intended to exclude the unspoken clauses. In the case of Exxonmobil Sales and Supply Corporation/Texaco Limited13, it was expressly stated in the entire contractual clause that the contract did not contain the full agreement between the parties with respect to the purpose and the terms of use. Section 92, subject to (1) of the IEA, reinforces this rule and provides: That oral evidence be admissible to prove that a contract is invalid or non-valid for fraud, coercion or illegality of the object.8 Oral evidence is also admitted to prove fraudulent misrepresentation.9 A full contractual clause has no bearing on the admissibility of extrinsic evidence in the case of proving liability for a contractor in the event of misrepresentation or proof of the impermanence of a contract. “This instrument contains all the consent of the parties to the purpose of this contract, and there is no other commitment, insurance, guarantee, use or practice that influences them.” Unless expressly stated otherwise, this agreement contains all the parties` understanding of the purpose of this agreement, and all previous written or oral agreements are replaced by this agreement. This agreement cannot be amended, amended, repealed or completed unless it is foreseen. In the case of Mears Ltd/Shoreline Housing Partnership Ltd,a social housing owner (Shoreline) entered into an agreement whereby Mears (a maintenance contractor) would operate Shoreline`s properties.
